On the 19th of May, 1938, officers of the Police and Harbour departments went out with witnesses to ascertain the exact position of the sampan when the three men on it were captured. Copies of the statements of these officers, and also of an expert calculation by the Assistant Harbour Master, based on them, of the Enclosure No.4. distance each of the positions given is within Hong Kong

territorial waters, according to the recent definition,

and from definite points in British territory, are enclosed.
